Authorized Use and Access
You must not use the Website unless you are at least 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and you are fully able and competent to enter into, abide by and comply with the terms, conditions, obligations, affirmations, representations and warranties set forth in the TOU.
So long as you comply with the TOU, RockHouse hereby grants you a personal, non-exclusive, non-transferable, limited license to enter and use the Website and the services provided thereby. The Website and this license are intended for use by RockHouse’s customers. As such, you may not use the Website for any purpose unrelated to your business with RockHouse. Additionally, you are prohibited from doing any of the following:
- Downloading, copying or transmitting any part of the Website without, or in violation of, a written Content License Agreement and/or any other relevant agreement with RockHouse;
- Hacking or using data mining, robots or any other illegitimate means to gain unauthorized access to any portion or feature of the Website, any systems or networks connected to the Website or to any of the services offered on or through the Website;
- Using the Website to obtain or attempt to obtain any documents, materials, videos, sound bites or information through any means not purposely and expressly made available or designed through the Website;

Ownership of the Website and its Contents
The Website and all content featured on the Website, including without limitation, text, graphics, photographs, images, footage, videos, sound, illustrations, data and software (individually and collectively, “Content”), as well as the design, layout, structure, coordination, selection, expression and arrangement of the Website and Content, is owned, controlled or licensed by RockHouse, its licensors and/or its content contributors, and are protected by trade dress, trademark, copyright and other pertinent intellectual property and unfair competition laws. Except as expressly permitted under the TOU or any other relevant written agreement entered into by and between you and RockHouse, no portion or element of the Website or Content may be copied, publicly displayed, reproduced, republished, posted, uploaded, transmitted or distributed in any manner, and all rights to the Website and/or Content shall remain vested in RockHouse, its licensors and/or its content contributors. Any unauthorized use in violation of this provision constitutes copyright infringement under the U.S. Copyright Act and international copyright laws. Violation(s) of these terms shall be deemed willful, and RockHouse, its licensors and/or its content contributors shall be entitled to enforce its rights to the fullest extent permitted by law.
Any and all RockHouse graphics, logos, and/or service names are protected trademarks or service marks (collectively, the “Trademarks”) owned by RockHouse. Unless expressly authorized in writing by RockHouse, you may not (1) use the Trademarks in connection with any product or service that is not owned or operated by RockHouse; (2) use the Trademarks in any way that would likely confuse you or your business with RockHouse; and/or (3) use the Trademarks in any manner that disparages or discredits RockHouse. All other branding, trademarks and logos appearing on the Website are the property of their respective owners. RockHouse makes no representations or warranties as to these other brands, trademarks and logos.
Any license granted to you herein or by virtue of your Content License Agreement with RockHouse and your account with RockHouse will automatically terminate without notice if you fail to comply with any provision of the TOU. Upon termination, you must delete and destroy all Content obtained from the Website, as well as any and all copies and related documentation thereof.
RockHouse further reserves the right to do any of the following, at any time, without prior notice: (1) modify, terminate or suspend access/operation to part(s) of or the entire Website; (2) modify or change any applicable policies or terms for the Website, including, but not limited to the TOU; and/or (3) interrupt the operation of the Website, or any portion thereof, in order to perform routine or non-routine maintenance, error correction, technical updates or other changes. RockHouse shall not be liable if for any reason, the Website, Content and/or related services is unavailable.
Your Warranty
You represent, warrant and covenant that:
- You will not use the Website or Content in any way that is not permitted by the TOU, your Content License Agreement with RockHouse or any other pertinent agreements with RockHouse;
- Your use of the Website and Content will not infringe any patent, trademark, trade secret, copyright or other intellectual property or contract rights of any party;
- You will not use the Website or Content in any way that is unlawful, libelous, defamatory, obscene, pornographic, harmful to minors, indecent, lewd, harassing, threatening, abusive, inflammatory, fraudulent, invasive of the privacy and/or publicity rights of any party or that would otherwise create liability or violate any local, state, national or international laws;
- The information you provide to RockHouse and/or the Website is accurate and true, including without limitation, any personal, business and credit card information;
- You agree that your log-in information for the Website will be held in the strictest of confidence, and that you will not share or disclose this information to any other user or third party other than as specifically provided for herein;
- You shall immediately notify RockHouse of any unauthorized use of your account or other breach of security; and
- You accept all responsibility for any and all activities that occur under your account.
